OOD Scoring

Using OOD Code, I have met a concern.

One sailor has sailed the minimum races to count with no OOD duties.

Another sailor has sailed one less than the minimum races to count plus one OOD duty and as a result has to count a DNS which puts him at a disadvantage (and he has been complaining).

Is there a way round this?

If 5 is minimum no. of races to count and he has sailed 4, isn’t his
OOD scored as the 5th race?
