Post Race Disqualification

Hi Guys

One of our Club members entered his Cat into a race organised by a
neighbouring club, he correctly started and completed the course and
was given a gun at the end, he is of the opinion that when handicaps
are taken into consideration he should have gained first place.

Some time after the race he was notified on telephone by the club in
question that his class of boat was not allowed to race so he was
disqualified from the race, no mention of the exclusion was found in
the Sailing Instructions nor have any amendments been observed.

Your views would be appreciated in how this issue should be handled,
one suggestion is that he should protest if excluded from the
results - do you have any other ideas ........... thanks for your
help.

ISAF Racing Rules of Sailing 76.1 and 86.1 b may be worth looking at regarding this. They state that the reason for refusal must be given and refusal must occur before the race. (Did he sign up and register?) This means the owner may want to lodge a protest now that he has been notified after the race. Rule 76.1 can not be modified by the SI's by the way.

Also some countries have national prescriptions that make it even tougher to not register boats than ISAF does. (ie Canada I think)
