So if a boat crosses the line and her transom has cleared the finishing line, then she is no longer
racing and thus not subject to penalties if she then hits the pin? What is the definition of
"Clears The Finishing Line"? Does "Clear" mean that her transom has crossed the line and she is no
longer on the race course or does "Clear" mean that she has to get well away from the finishing
line? I think that is the crux of the discussion here.

No that is incorrect, you are subject to penalties after you finish. Rule 31
1 states that a boat shall not touch "a finishing mark after finishing". The
interpretation that I have always had has been explained to me by IJ's is
that you can never touch a finish mark... Even if you finish and five
minutes later are sailing in the area of the finish line and touch the mark,
you are required to refinish. The finish mark stops being a finish mark when
you move it for the next race.

Racing A boat is racing from her preparatory signal until she finishes
and clears the finishing line and marks or retires, or until the race
committee signals a general recall, postponment or abandonment.

Part 2 - When Baots Meet
The rules of Part 2 apply between boats that are sailing in or near the
racing area and intend to race, are racing, or have been racing.
However, a boat not racing shall not be penalized for breaking one of
these rules, except rule 22.1.

Once you have finished and cleared the finish line you are not racing
and not subject to penalty for hitting the mark, so NO if you hit the
finsihing mark once you have cleared the line it means nothing. The
only time it could matter is if you did it on purpose in an effort to
disadvantage another in which case the fair sailing rule would come
into play and you could be penalized, but not for hitting the mark.

The interpretation really comes down to what does "clears the finish line"
mean.

If two boats finish on opposite tacks and the collide just after both boats
transoms cross the line, is there an infringement of the rules. I believe so
and that the port tack boat must do a 720 and refinish. The same applies for
the finishing mark that is even if you have finished and your transom has
crossed the finish line, you have not cleared the finishing line until you
sail completely away from the finishing area.

    what about yachts, as soon as they have completely crossed the line they
tend to start their engine, if they haven't finished racing, and are still
subject to the rules and penalties, then they must be breaking the rules,
which suggests it is all over done and finished once you have completely
crossed the line. What does anyone else think

If a boat finishes on port, just ahead of a starboard boat, that they can
not cross, is it legal for them to start their engine to avoid the port
starboard? I would think not....

and that the port tack boat must do a 720 and refinish. The same applies

crossed the finish line, you have not cleared the finishing line until you
sail completely away from the finishing area.

these rules, except rule 22.1.

Once you have finished and cleared the finish line you are not racing

and not subject to penalty for hitting the mark, so NO if you hit the

finsihing mark once you have cleared the line it means nothing. The

only time it could matter is if you did it on purpose in an effort to

disadvantage another in which case the fair sailing rule would come

into play and you could be penalized, but not for hitting the mark.

Clears the line means that no part of your boat is on the finsih line. You can clear it by backing up or by continueing forward. Once you are no longer over the line you are no longer racing. If two boats have a port / starboard 10 seconds after they have both cleared the line, there is no rule infraction any more than there would be 10 minutes later. If you are not racing you can not break the racing rules.

I have watched the many recent emails on this saga with some amazement.

The answer is actually very simple:

Rule 31 certainly applies if you touch the finishing mark but only while
racing (the first two words of rule 31.1).

The Definition of Racing says that "A boat is racing from her preparatory
signal until she finishes and clears the finishing line ..."

It is therefore nonsense to suggest that she can be penalised for touching a
finishing mark at any later time (provided of course she has cleared the
line). When once a boat has finished then from her point of view the race
is over and such infringements cannot occur.

I just completed the USSailing Race Management Seminar and brought up this
question.

Once you have finished (i.e. cleared any penalty obligations) and cleared
the finish line (i.e. no part of the hull or equipment is on the line), you
are no longer racing. You can sail back and IMMEDIATELY hit the finishing
mark if you want to without penalty. Also you are no longer bound by the
RRS, but of course are still bound by the Rules of the Road. However, if you
deliberately (or through your own negligence) interfere with another
competitor who is still racing, you may be penalized under the fundamental
fair sailing rule and/or the competitor may receive redress.
