[sailwave] Sailwave license agreement

To be honest Tom, I personally don’t understand the root of the concern. Our legal beagles derived the Commercialism Policy from their interpretation of the legal docs. I consulted the committee specifically with this issue. I have forwarded the earlier reply on this list to them for their consideration, and will forward yours as well.

I, and indeed the club, agree that as the only cost for SailWave this request is very reasonable and generous. As I noted in my original post it is not a matter of cost or lack appreciation for Colin’s efforts. It’s strictly an attempt to avoid any hint of jeopadizing our not-for-profit status. Apparently there are circumstances in which linking to a commercial site can do just that. What circumstances I don’t know, but our web committee, of which I am a member, has been warned to be careful what links are used.

I want to give Colin and SailWave any and all recognition we can, but I have to work within my club’s policies. Having the URL as text, but not a live link is acceptable, presumably because it takes a specific effort on the user’s part to copy and paste the link into the address field.

If this concern is deemed unfounded upon further review I’ll let you all know and accommodate Colin in his original request.

Our sailing club is also a not for profit organization. We have links on

our website to boat manufacturers, boat dealers, parts suppliers and off

course to Sailwave. We do not profit from any of those links. Many of them

have links to our site. We do not profit from those links either. I fail

to see how your club feels that associating with any commercial organization

impacts your non-profit status. Does your club own any Race Committee

boats? Did your buying them affiliate you with the commercial organization

that you bought them from? I don’t think so. The purchase price to your

club for the use of Sailwave is to maintain links to the product. I feel

that is a very reasonable and generous request. If that price is too high

for you, you can purchase another product with $'s and eliminate the

commercializing link.
